Service terms and conditions for medical equipment services

These Terms & Conditions (“Terms”) govern your use of Motiv Medical’s medical equipment services and communications. By accepting our services, you agree to be bound by these terms and conditions.

1. Medical Equipment Services

Motiv Medical provides medical equipment and related services as prescribed by your healthcare provider. All equipment is provided in accordance with physician orders and insurance coverage guidelines. Our services include equipment delivery, setup, maintenance, and patient support.

2. Service Agreement

By accepting our services, you agree to comply with the following requirements:

  • Provide accurate and complete contact and insurance information
  • Follow all equipment usage instructions and safety guidelines provided
  • Allow reasonable access for equipment delivery, setup, and maintenance
  • Report any equipment malfunctions or issues promptly to our service team
  • Maintain equipment in good condition and use only as prescribed

3. SMS Text Messaging Terms

Consent Notice: By providing your mobile phone number to Motiv Medical (either directly or through your healthcare provider), you expressly consent to receive SMS text messages regarding your medical equipment services.

Types of Text Messages

You may receive the following types of SMS messages from Motiv Medical:

  • Equipment delivery notifications and scheduling confirmations
  • Setup appointment confirmations and reminders
  • Service and maintenance appointment notifications
  • Insurance and billing related communications
  • Important safety updates about your medical equipment
  • Equipment pickup or return scheduling

Message Frequency

Message frequency varies based on your individual service needs and may include:

  • 1-3 messages during the initial equipment delivery process
  • Periodic service reminders as needed for your equipment
  • Messages sent only when necessary for your medical equipment services

Important: We do not send promotional, marketing, or advertising messages via SMS.

How to Stop Text Messages

To STOP receiving messages, reply STOP to any text message

Opt-Out Options

You may discontinue SMS communications at any time using any of the following methods:

  • Reply STOP to any text message you receive
  • Call our office at (513) 456-2722 during business hours
  • Send an email request to info@motivmedical.com

You will receive a confirmation message when you successfully opt out of SMS communications.

Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier and service plan. Motiv Medical does not charge fees for text messages, but your wireless carrier may impose charges according to your plan. Contact your carrier for information about messaging rates.

Technical Support

For technical support with SMS services, reply HELP to any message or contact our support team during business hours.

4. Equipment Responsibility and Care

As a recipient of medical equipment, you acknowledge and agree that:

  • You are responsible for the proper care, use, and security of all equipment provided
  • Equipment must be used only as prescribed and in accordance with provided instructions
  • You will immediately report any damage, malfunction, or safety concerns
  • Equipment must be returned promptly when no longer medically necessary
  • You may be responsible for replacement costs if equipment is damaged due to misuse or neglect

5. Insurance and Billing

Services are billed in accordance with your insurance coverage and applicable healthcare regulations. You understand and agree that:

  • You are responsible for any co-payments, deductibles, or non-covered services
  • Insurance coverage determinations are made by your insurance provider
  • We will assist with insurance verification and claims processing
  • Payment is due for any services not covered by insurance

6. Limitation of Liability

Motiv Medical provides equipment and services with professional care and in good faith. Our liability is limited as follows:

  • We are not liable for indirect, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid for services
  • We are not responsible for treatment decisions made by healthcare providers
  • Equipment is provided “as is” according to manufacturer specifications

This limitation of liability is subject to applicable state and federal laws and does not affect any rights that cannot be excluded or limited by law.

7. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective when posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the modified terms.

8. Governing Law

These Terms & Conditions are governed by the laws of the State of Ohio and applicable federal laws. Any disputes will be resolved in the appropriate courts of Hamilton County, Ohio.
